New Subaru Starlink Lawsuit Update And What You Need To Know Now

There is a new update concerning the Subaru Starlink lawsuit. Here are the latest details customers should be aware of.

Here are the latest details concerning the Subaru Starlink lawsuit that customers should be aware of. Top Class Actions states, “A federal judge in New Jersey declined to dismiss a class action lawsuit accusing Subaru of manufacturing and selling certain vehicles containing defective Starlink infotainment systems.” Here is what it means for customers.

“U.S. District Judge Robert B. Kugler determined the court did not have enough facts to dismiss the common law claims of fraud, breach of warranty, unjust enrichment, and fraudulent concealment.” 

Subaru attempted to dismiss the claims and argued some of the claims were untimely and that any warranty would have been made solely by Subaru of America. The judge ruled it was too early to distinguish the liability or severability between Subaru of America and Subaru Corporation.

In the Subaru Starlink lawsuit, the judge ruled that the class action adequately alleged the Starlink information systems did not work as advertised. 

Subaru Starlink Lawsuit Overview 

As I reported in April of last year, attorneys Andrew W. Ferich, Robert R. Ahdoot, and Bradley K. King of Ahdoot and Wolfson, PC filed the lawsuit against Subaru, claiming the automaker is guilty of “unjust enrichment, common law fraud, and fraudulent concealment, and of violating the New Hampshire Consumer Protection Act and New York General Business Law, among other things.”

What Subaru Vehicles Are Included In The Starlink Lawsuit?

According to the Subaru class action, Subaru vehicles equipped with the allegedly defective Starlink infotainment system include the 2019-2023 Subaru Outback, Forester, WRX, and Legacy.

Plaintiffs Marco Cillufo (2021 Subaru WRX), Jeffrey Quarles (2019 Subaru Forester), Pamela Doze (2022 Subaru Outback), and Carl Jean-Louis (2019 Subaru WRX) claim the allegedly defective Subaru Starlink system “Presents a safety risk for drivers of the 2019-2023 Subaru Outback, Forester, WRX, and Legacy vehicles by disabling safety features and presenting drivers with distracting and frustrating effects.”

The plaintiffs argue further that Subaru falsely promises the Starlink systems will provide drivers with “seamless navigation,” “extra safety,” and “everyday convenience.” 

“Instead, Subaru sells and leases class vehicles equipped with defective Starlink systems that fail intermittently or altogether, causing serious inconvenience and safety concerns for lessees and owners, their passengers, and other drivers on the road,” the class action states. 

The report says plaintiffs Cillufo, Quarles, Doze, and Jean-Louis “are demanding a jury trial and requesting injunctive relief along with an award of punitive damages for themselves and all class members.”

The plaintiffs also argue that Subaru must be aware of the alleged defect based on “related service bulletins” since it conducted pre-release vehicle testing and the alleged defect “manifests so quickly.” 

What can Subaru owners do?

If you are experiencing problems with your Subaru Starlink system in your 2019-2023 Subaru Outback, Forester, WRX, or Legacy, take your vehicle to a Subaru retailer. Mine freezes, comes and goes on Home Screen. My phone wouldn’t connect to the Outback anymore. Maps would not work… asked at dealer when in for a service and told I would have to come in just for that. Came back later, a tech programed my phone thru my Subaru app said we don’t use Starlink anymore. The Starlink app comes and goes on screen still.

Seemed to happen when the weather got to about 40 degrees, I have red, wavy lines going through the touchscreen on media mode. On the radio mode the entire screen is red, which is super obnoxious at night! Map screen ok but the backup camera distorted with red wavy lines. Stayed this way for 3 weeks, then miraculously it went back to normal. I have come to believe Subaru's infotainment system is less than par.

purchased a 2019 legacy sport in August 2022. I was not aware of any issues until recently when i had to replace my battery 2 times as it would be drained somehow without my knowledge. Learned about a DCM issue and removed a fuse in slot 9 that eliminated the drain but caused front speaker to not work which caused the bluetooth phone connection and navigation voice to also not work. Found a method to jump slot 19 to slot 9 and that resolved the issue but this is still not correct. Was not able to join the class action as it closed before my purchase. Am i SOL ?

In September 2023, the dealer quickly agreed to replace my starlink system in my 2019 Outback which was long out of warranty. My symptoms were just like yours, The battery would die after parking the car for 3 days, starting early in 2023. I measured the parasite current with a clamp meter, found the offending fuse by probing for mV voltage on fuses in the engine fuse box, and then measured battery drain using a wireless data logger. This photo shows two graphs: the voltage dropping until the battery dies, and then the voltage not dropping after removing the fuse.

While waiting for the backorder replacement module to arrive, I used a wire in the fuse box to power the system via ignition-on fuse.

I recently bought a 2023 Subaru WRX Premium B. The Subaru Starlink is wonky “nicely putting it” on my new car.
It wigs out and has froze up several times to the point I took it in to the dealership to be looked at. They said it needed an update but it still had the same issues.
Premium technology that doesn’t work correctly go figure.
One expects more from Subaru especially at the price tag we the consumers have to fork over.

They told me they would reply he screen but here we are again and they still won’, they told me tobuy a new 2024 WRX Limited because that’s the only way! Supposedly they can’t put the 2024 WRX limited screen in a 2022.

I have a 2023 Outback. The info center regularly crashes when using Google maps. If I make an "undirected turn" the map either freezes or the whole unit locks up. I have brought this problem to the attention of the local dealership on each visit. Their reply is that the system is up to date.

I bought a 2024 Outback last May. I wouldn't call the infotainment system "defective" but it absolutely sucks. For the first minute of the car being started it's extremely laggy, taking multiple seconds to acknowledge buttons pushed, if it even does. Even after that I consider it very slow. It's almost a distraction since you can't always trust anything happened when you push a button. The climate controls are always laggy. When opening the menu for additional settings it always takes multiple seconds and then you need to watch it to see if it actually acknowledged what you pressed- again, a dangerous distraction if driving. CarPlay picks and chooses when it's going to connect and it messes up settings on your iPhone and Apple Watch even when it's not connected. I had to abandon using it. It's disappointing enough that I might consider this my first and last Subaru. And next time we're buying a new car I'll definitely be looking a lot closer at the infotainment systems- the one thing I never considered being a variable in buying a car.

I bought a 2022 Forrester and the starlink does not work all the time. The link comes and goes at will, we have not taken it to the dealership as of yet since we just found the link last night.

2022 Forester: Has misdirected me several times, last week my home address was non-existent while my neighbor's was not.

Am I to understand this is more than Elon making life more difficult for those of us not driving a Tesla?

We own 2022 Outback Wilderness. Our screen along with all safety features has blanked out multiple times. Most of the time it's crossing time zones for us. We have had 3-5 instances of this failure, I mentioned to our service tech at more than than 1 dealership. No answers or instructions on how we should proceed. Starlink and Tom Tom Navigation are less than optimal. I've had handheld Garmin devices that far surpass Subaru in car systems. Still love our Subaru but a full brain work over would be nice. Something that we will consider in our future vehicle purchases.

I have a 2015 Subaru Outback which was sold with Starlink. It was supposed to be the new and upcoming feature of the car. I tried and tried to hook it up to my phone. I took it in a few times to no avail. Subaru then discontinued Starlink and it was removed from my car in late 2015 - early 2016 and has never returned.

This is not an small inconvenience, when you are going down hill on a major thruway with a tractor trailer behind you that’s doing well over 85 and your entire screen goes black, that it is more than just unsettling, it is a dangerous safety issue!

So they knew about this when they sold me my Brand new WRX Iin 2022???

Starlink was a major selling point for my WRX. Now I learn the. whole time Subaru has just been giving me the run around and they knew all along it was defective. Subaru and the sales people advertised and sold a defective product.
My WRX is about 15 months old with 12,000 miles and have been getting the run around from our Subaru service center for months and lied to since first encountering the problem.

They blamed my
Apple iPhone so bought a new one, they repeatedly blamed my charger so I purchase ones.
The repeated software updates failed to fix problems.
I purchased my Subaru WRX Premium November 2022.
Again I am driving a loaner because they still have not fixed all the problems the Starlink causes. The last time they said if their “fix” dis t work they would replace the screen but here we are again April 2024 and they won’t replace it.
I have been with out my car repeatedly because they can’t fix it, this time for a week.

They told me yesterday if I want Starlink the new WRX Limited version doesn’t have black screen issues AND they will have sales call me to buy a NEW limited 2024! Their solution is for me to buy another new car in the next model!

I bought a 2023 Subaru Outback Limited brand new last December and the Starlink navigation locks up and intermittently says “Loading Navigation” on the nav screen. Then it may lock up and repeat directions to an odd address that I didn’t enter. It asks if I want to go there and when I press the “No” icon it just repeats itself. Shutting down the engine and waiting a minute before restarting usually fixes it.

Updated the new software release yesterday and we’ll see what happens now! Taking a long road trip at the end of this month and taking a phone with navigation just in case.

I bought a 2023 Subaru Outback XT in December of 2022. I have been wrestling with the dealership the entire time. Problems such as: receiving phone calls from non-existent numbers, then the radio shuts down. Sometimes after stopping and restarting the car I was able to use my radio again. After bringing it in to the dealership numerous times, they said my phone is too old for Subaru software. I buy a new phone, a Motorola edge Android. My Navigation blacks out in the middle of my trip. Very frustrating when I don't have directions to get my son to the Mayo Clinic for cancer treatment. Even after the March 6th update of my vehicles software the Navigation has dropped two times. My last visit I was informed that all of my problems are with my phone, yes, the new one.

Thank you to everyone who has worked to get this Class Action Law suit started.
One final comment: I contacted the Better Business Bureau about this problem. Finally the dealership is starting to take me seriously. Sounds like they want to give me a phone they claim will work better.
I wonder why they didn't tell me which phone works best BEFORE I purchased it???

Since the day I purchased my 2021 Outback, I’ve had nothing but problems with my infotainment system. I had it in for updates numerous times and have noticed very few improvements. The navigation system is an absolute disaster and the voice commands are worthless. Sometimes my entire screen just freezes and/or resets.

This is my first Subaru and I want to love it, but the infotainment system is just a horrible integration into an awesome vehicle. It’s super slow compared to other vehicles I’ve owned and the “safety” features the car includes are more distracting than helpful. I hate to say I regret the purchase, but…

So now my 3 year 36k mile warranty has expired and I have no other options but to live with I bought.

How do I get involved in this class action?

2023 Subaru Crosstrek Limited - is it possible to add Crosstrek's to this lawsuit? Beginning a month after purchase there have been a litany of issues with the infotainment system and Starlink. After being repeatedly dismissed with mansplained excuses from the dealership for several months, the car spending weeks and weeks at the dealership for evaluations, and chasing these issues for a year now there is no fix in the foreseeable future. Mine cannot possibly be the only Crosstrek with this issue. SOA is offering 3 options for settlement under Lemon Law statutes.

As a previous commenter stated - I want to love my Subaru. I do love my Subaru - the overall road performance is great. The issue with the radiohead and Starlink system has come with a year of frustration and wasted time dealing with it.

It should be noted that there is a tremendous backlog for repaired Starlink units (also known as "head" units). Each defective unit must be rebuilt because that model is no longer made by Subaru's subcontractor. I believe it is now down to about a six month wait. For me, because Subaru "lost" my paperwork and then wasn't able to send my dealership repaired units for two months for some reason, my wait was 11 months!

How do I join the class action lawsuit regarding the Starlink System failure on 2019 Outback? I'm negotiating with SOA to get a voucher to replace it but it probably won't cover the cost of replacement and there's no guarantee that a new system replacement won't be defective as well.

My Starlink went bad last summer....two repair visits and several months of waiting around for a back ordered, refurbished unit to arrive. It works now, but it's my understanding that they are ALL bad and I have a ticking time-bomb that will again malfunction.

I have a 2019 Legacy. Buttons in system stop working. Updates have installed multiple times and it works for an hour and then stops again. Screen changes on its own and has called and texted my last contact that I spoke to or messaged on its own.
I was trying to fix on my own before going to dealership. From what I’m seeing maybe this will be my last Subaru.

I bought my 2019 Subaru Outback and last year noticed a kinda haze look to the screen. The past year the screen reacts so strangely and makes the volume go all the way up randomly. More so recently it looks like a ghost is operating it, changing stations and opening all the apps. It’s incredibly distracting and sometimes scary bc it is loud and unexpected.

I have a 2018 Outback , that had bubbles form on the screen and in the past few weeks, nothing works on the screen- GPS, radio, connecting phone, heat, defrost and it will either freeze totally or constantly flashing. I just learned of lawsuit and that others have this problem. Trying to resolve.
