New Subaru Cracked Windshield Lawsuit Settlement Involves 1.4M Vehicles, What Customers Need To Know

Subaru has a settlement in place now for its cracked windshield lawsuit. See what Forester, Outback, Ascent, and Legacy owners will receive under the proposed settlement.

Subaru of America has settled its cracked windshield lawsuit for the owners of 1.4 million vehicles. According to Top Class Actions, Subaru of America agreed to settle the lawsuit with the owners of the 2019-2022 Forester, 2019-2022 Ascent vehicles, 2020-2022 Outback, and 2020-2022 Legacy vehicles.

Before I give you the proposed settlement details, here is information on the history of the Subaru cracked windshield lawsuit. I started covering the lawsuit more than four years ago. Several lawsuits were consolidated into one class action lawsuit. 

According to the lawsuit, "defects cause minor chips in the glass to spread across the windshield." Subaru argued that the windshields met all federal safety regulations. While the plaintiffs complained that dealerships wouldn't cover the cost of windshield repairs under warranty, Subaru argued that the warranty didn't cover such damage.

The class action lawsuit also alleged Subaru knew about the windshield problems because dealers were issued technical service bulletin (TSB) 12-192-15R.

According to the plaintiffs, replacing the windshield is useless because Subaru uses the same defective windshields as replacements. In addition, the class action lawsuit alleged that repairing or replacing the windshield affects Subaru's EyeSight driver asset safety technology. Recalibrating the safety system is an additional cost.

Drivers whose vehicles are included in the windshield defect class action chose their vehicle because it offered the EyeSight safety feature. "So having the technology rendered useless by the windshield defect poses financial injury to drivers."

Four Years Of Litigation

After four years of litigation, 13 depositions, tens of thousands of pages of discovery documents, subpoenas, and more involving a projected class of owners, former owners, and lessees are getting windshield replacements and refunds under the proposed settlement.

There were originally 16 named plaintiffs in the Subaru lawsuit, but only four were involved by settlement time. Subaru of America denies all wrongdoing and denies the windshields are defective. A report from CarComplaints says, "The automaker says it decided to settle the lawsuit to end the expensive and time-consuming litigation."

Here is What Subaru Of America Agreed To:

1. Subaru agreed to an extended warranty of eight years or 100,000 miles and a one-time windshield replacement as part of a class action settlement submitted for preliminary approval in the U.S. District Court for the District of New Jersey.

2. The agreement says, "The Subaru cracked windshield extended warranty is limited to a one-time replacement of the windshield. Once replacement occurs, this will end the extended warranty as it expires once the windshield has been replaced."

3. The settlement also calls for reimbursement of documented prior windshield replacements with proof of a qualifying windshield crack. Subaru customers will only be reimbursed if damage was caused by residual windshield stress, not any other cause.

4. The cracked windshield settlement says there is a process Forester, Outback, Ascent, and Legacy owners must go through to "prove that their loss was caused by the alleged defect as opposed to impact damage that would have caused a cracked windshield regardless of any alleged defect."

Subaru Has A New Process For Manufacturing The Defective Windshields

5. The settlement agreement says, "The new windshield will be manufactured with a revised process that substantially reduces the likelihood of a crack/damage occurring to a windshield from a minor impact and residual stress."

What Should Customers Do?

Subaru Forester, Outback, Ascent, or Legacy must know that though the parties have agreed to settle the cracked windshield class action lawsuit, a federal judge must still grant preliminary and final approval to the terms before anything is official. I drive Subaru Outback Wilderness 2022 and had to replace windshield 3 x since purchase. Absolutely unacceptable.

I am on my 3rd windshield. The first 2 were saidto have happened because of rock chips that I swore never happened. Out of pocket costs were $300 for both. DISSATISFIED AND DISSAPOINTED.

'21 Forester - got a crack almost right away that spread because of cold temps. Seemed to have come from the edge of the glass, and didn't see a chip

It started with a small chip on my 2022 impreza sport. It spread very quickly rendering my eyesight useless. I had the windshield replaced at a very high cost. 2 weeks later the new windshield cracked on its own and also spread across the windshield in 1 day. I am now on my third windshield and paid for everything out of pocket.

I drive a 2021 Ascent and have had to have one windshield replaced in November 2023 and now in March 24 I have the same cracking starting behind the rearview mirror and extending at a rapid pace to cover the entire top of the windshield and going down now.
I have never in 40 years had to replace a windshield an now 2 within 6 months.

I have a 2020 Outback and am on my 3rd windshield! At the cost of a windshield and calibration of the eyesight system, that's a lot of money.

I own a 2022 Subaru Forrester and got a crack on the windshield. I had the windshield replaced not once but twice ( But not by Subaru) now none of the safety features work. I’ve had it recalibrated twice they still don’t work. I never did call Subaru where I bought it from brand new because I didn’t think they would do anything about it. Can you give me some insight on all this?

In my 22’ forester I have had two impacts resulting in broken windshields. This wasn’t the only issue. I’ve had 5 windshield and two eyesight systems installed due to new OEM windshields not calibrating and having multiple attempts. My state doesn’t have glass coverage so it’s covered by my comprehensive. My insurance has gone up Almost $200 every six months. The cost of replacement out of pocket with recalibration would be around $1300

We bought a 2019 Ascent when they first came out, received it in August. When the weather turned cold, as we were driving (no traffic), we heard a pop, not a ding. Told the subaru place in Anchorage, Alaska about it and they would not own up to that the windshield was a problem. Since then, we have been driving a cracked windshield that has spread. What should we do to get the windshield replaced?

I owe a 2020 Subaru Ascent. I have had two cracked windshields replaced. First cracked happened spontaneously when sitting in parking lot and heard a cracking noise and saw a crack spreading across about half or more of the windshield. Second time there was something small that hit and chipped my windshield that then cracked. Insurance paid total cost both times.
Now the person who detailed my car pointed out a crack in the glass on my rooftop window. I haven't opened it in more than a year or more. Does lawsuit cover this window ?

I have a 2024 Forester Sport and in the last month I have had 2 - 3 pings on my windshield, but so far it hasn't spread. I see that the lawsuit is for model years up to 2022. Anyone know if the glass has been fixed in the 2023 - 2024 years?

I bought a 2020 Subaru outback in September 2019. Two months later the windshield cracked. It was replaced with a non-OEM windshield and the Subaru dealer refused to calibrate the eyesight function. I had to have the windshield replaced again with a Subaru windshield.

I drive a 2022 Subaru Legacy Limited XT (original owner) and I'm currently on my 5th windshield. The first two windshields cracked in the exact same place within six months of purchase.

I have a 2019 Outback with a cracked from a rick chip that is spreading up near the eyesight. Weird that only 2020-2022 outback were included when 2019 of other models were included.

I would Not by another Subaru Outback without inclusion of a functional method to adjust the alignment of the rear suspension. Currently the Outback is being sold with Out Of Alignment rear suspensions. After a call and case to SOA, they don’t care. Bad, Bad construction of a car.

2019 Outback
Have 3 replacement windshields to date. Existing windshield has crack that started at lower corner on passenger side and has worked its way across to interior rear view mirror. Know 2 cracks were from rock or something hitting glass.
Interesting there is improved glass and 2019 Outback’s not covered:)

I just replaced my windshield for the forth time. The first two windshields were within the first two months after purchasing it new in 2022. I just put my forth one in last week.

I don’t feel that the settlement is fair.
I won’t ever buy another Subaru because of this.

We were happy to have added an additional broken windshield coverage when we purchased it. We are on windshield #5. The littlest peebles on the roadway will crack these windshields. The additional coverage ends in 2026. We love our Outback, but we cannot afford more windshields when the coverage ends.

I am on my fourth windshield replacement for my 2022 Subaru Outback in the last 12 months. I just drive to and from work except for a few, very sedate, trips out to the lake. I kept getting Subaru glass because my service advisors kept warning me not to go with the "after-market glass" they assured me my insurance company would use.

Many cracks just appeared with no discernable cause and even the smallest rock chips immediately turned into giant, multi-legged cracks running all the way across the windshield. This last crack came out of nowhere and, like the rest of them, seems to expand while the car is just sitting in a parking space.

My insurance company has full glass replacement coverage but scheduling a replacement is a giant pain because I also have a full-time job and no ability to just drop the vehicle off for repairs, so I have to take time off work and wait for the repair to be completed. I've been getting Subaru glass each time but this last time I just had my insurance company send me wherever they want because I was not confident that the Subaru glass was worth the hassle. Only now am I seeing this article and I'm pretty sure I had no idea this lawsuit was ongoing.
I love my Subie, and I've had great service. I just wish they'd been more open about this so our service advisors could be honest with us.

I bought a 2021 forester in Nov of 2021, 2 weeks later driving to work a pebble hit the windshield and the whole thing crack. About 1 year later it happened again. I live in Florida so the insurance took cars of it. Had to go to Safelife for the replacement so it could get calibrated. It didn't cost me anything except for my insurance going up.

I had a small chip that I went out and bought a chip repair kit that day and filled in the chip. The next morning I drove to work and hit a small pothole and the windshield cracked from top to bottom. I never thought a windshield would crack like that.

We have a 22 Subaru Outback, and had a small chip from a semi that went all the way across our windshield within 5 minutes of the strike. We had the windshield replaced through an insurance claim. Saflite did the replacement and Eyesight re-calibration.

My 2019 Forester windshield starting cracking on on July 19, 2019 on my way to lunch. It started on the lower driver's side & spread across to the passenger side within hours. In 24 hours it was in the middle of the windshield. Had replacement within days cost & recalibrated was approximately $900. National Highway Traffic Safety Admin was notified & Subaru.
