Subaru of America has settled its cracked windshield lawsuit for the owners of 1.4 million vehicles. According to Top Class Actions, Subaru of America agreed to settle the lawsuit with the owners of the 2019-2022 Forester, 2019-2022 Ascent vehicles, 2020-2022 Outback, and 2020-2022 Legacy vehicles.
Before I give you the proposed settlement details, here is information on the history of the Subaru cracked windshield lawsuit. I started covering the lawsuit more than four years ago. Several lawsuits were consolidated into one class action lawsuit.
According to the lawsuit, "defects cause minor chips in the glass to spread across the windshield." Subaru argued that the windshields met all federal safety regulations. While the plaintiffs complained that dealerships wouldn't cover the cost of windshield repairs under warranty, Subaru argued that the warranty didn't cover such damage.
The class action lawsuit also alleged Subaru knew about the windshield problems because dealers were issued technical service bulletin (TSB) 12-192-15R.
According to the plaintiffs, replacing the windshield is useless because Subaru uses the same defective windshields as replacements. In addition, the class action lawsuit alleged that repairing or replacing the windshield affects Subaru's EyeSight driver asset safety technology. Recalibrating the safety system is an additional cost.

Drivers whose vehicles are included in the windshield defect class action chose their vehicle because it offered the EyeSight safety feature. "So having the technology rendered useless by the windshield defect poses financial injury to drivers."
Four Years Of Litigation
After four years of litigation, 13 depositions, tens of thousands of pages of discovery documents, subpoenas, and more involving a projected class of owners, former owners, and lessees are getting windshield replacements and refunds under the proposed settlement.
There were originally 16 named plaintiffs in the Subaru lawsuit, but only four were involved by settlement time. Subaru of America denies all wrongdoing and denies the windshields are defective. A report from CarComplaints says, "The automaker says it decided to settle the lawsuit to end the expensive and time-consuming litigation."
Here is What Subaru Of America Agreed To:
1. Subaru agreed to an extended warranty of eight years or 100,000 miles and a one-time windshield replacement as part of a class action settlement submitted for preliminary approval in the U.S. District Court for the District of New Jersey.
2. The agreement says, "The Subaru cracked windshield extended warranty is limited to a one-time replacement of the windshield. Once replacement occurs, this will end the extended warranty as it expires once the windshield has been replaced."

3. The settlement also calls for reimbursement of documented prior windshield replacements with proof of a qualifying windshield crack. Subaru customers will only be reimbursed if damage was caused by residual windshield stress, not any other cause.
4. The cracked windshield settlement says there is a process Forester, Outback, Ascent, and Legacy owners must go through to "prove that their loss was caused by the alleged defect as opposed to impact damage that would have caused a cracked windshield regardless of any alleged defect."
Subaru Has A New Process For Manufacturing The Defective Windshields
5. The settlement agreement says, "The new windshield will be manufactured with a revised process that substantially reduces the likelihood of a crack/damage occurring to a windshield from a minor impact and residual stress."
What Should Customers Do?
Subaru Forester, Outback, Ascent, or Legacy must know that though the parties have agreed to settle the cracked windshield class action lawsuit, a federal judge must still grant preliminary and final approval to the terms before anything is official. 2019 Forester. Replaced windshield after hearing a single small ting from what must have been a large grain of sand. Hit it an inch from edge. A mile later and we had a 12 inch crack.
The proposed agreement #5 makes it sound like subaru agrees that the original windshields were not up to snuff.

I have a 2020 Subaru Outback. In 2022 a crack occurred that went across my windshield. I could see no cause. Took to dealership and they said it must have been a small rock that had hit my windshield, even though no rock had hit the windshield when I was driving and I’m the only driver. They said it wasn’t covered by warranty and told me who would fix it. I told them at the time that it was ridiculous because it was obviously a faulty product. It would be great if I could get my money back for replacement. I was out of town and had to get Uber to and from windshield replacement shop. It was a real pain and actually has made me not want a Subaru for my next car purchase. Bad marketing to blame the customer.

We have a 2018 Subaru Outback that had a cracked windshield that started below the hood line . Of course the dealer told me it was caused by road debris and also denied Subaru having problems with windshields cracking. We had to pay for the repair. We also have had problems with radio and navigation screen with no repair available. For this reason and the dealer in denial about any problems we will not be purchasing another Subaru. I have a 2019 subaru outback that has has the windshield replaced 4 times. 3 have been at my expense as subaru completely claimed that they windshield was no defective. The windshields would get giant cracks across the passenger to driver side almost spontaneously. I replaced them right away and recalibrate the eyesight. Almost 4k of windshield parts and recalibrate labor for the events in total. I was concerned with safety not having a clear windshield and it was very costly and stressful

2022 Outback - I had a crack start along the passenger side of my windshield for no reason at all. There was no impact and no reason for it to crack. The crack spread each day until I could get it replaced a few weeks later. I had it replaced at Safelite for $982.71.

Funny Story...not! However, I am now on my 5th windshield on my 2021 Subaru Forester Limited. First two times were on Subaru's dime, defective pitted glass the first time and then it cracked during a rain storm during a 90° day 3 days after installation. The NEXT (2) two replacements (a rock and then 1 week later, due to me complaining the windshield was not centered on installation, replaced again) were done by Safelite with OEM glass. When the dealership replaced my windshield the first two times, it was done by a local 3rd party glass company in Frederick, MD with NO AFFILIATION TO SUBARU CORPORATE however they used OEM windshield. I was told by Safelite they are required to use OEM glass on my Subaru due to my insurance coverage which is 0 zero dollars out of my pocket.
So yesterday, first 90 plus degree day, I come back to my car in the afternoon in the parking lot where I commute from and you guessed it..... another crack. Does look like something hit it but it was in a parking lot, not moving, so possibly a rock had hit it sometime in the past and then the 90° day was enough to cause the stress crack. So, I will be calling Safelite for windshield number (6) SIX! To be honest, the calibration done by Safelite always seemed to be better than when the dealership did it.

Looks like the windshield issue is universal. My 2023 Solterra also had a windshield go bad 1 month after purchase. It looks like the glass is cooled too quickly and becomes brittle. The stress in the glass goes way up and any little chip turns into a crack. The just replaced the windshield under warrantee and two days later I have another chip that's starting to crack already. I think it's time Subaru just admits it has been purchasing bad windshields and switch suppliers. They should replace everyones failed windshields for an extended period.

I own a 2017 Crosstrek. I have had to replace my windshield twice since buying this car. Both times a horizontal crack appeared slightly above the passenger windshield wiper. Both times the dealer claimed it was due to an unidentified strike, my word against theirs, guess who ended up paying for the repair. The windshield on my 2020 Outback Touring with 31,000 miles has been replaced twice.

2019 Subaru Impreza Limited. Car parked in our driveway, came out in the morning and noticed a small "chip" like mid windshield on the driver's side. Nothing that appeared to be able to cause problems. Every day it spread until there was a large crack running across the driver's side and towards the middle. Right off the bat my 2021 Forester's windshield developed a J shaped crack while driving down the road. No impact or external reason for the fracture. Dealership ran a ball point pen down the crack and said they found an impact crater. I think the pen made the crater. Insurance paid for the new windshield and SOA paid me the cost of my insurance deductible, $100. It would appear that my insurance company is due repayment.
