New Subaru Cracked Windshield Lawsuit Settlement Involves 1.4M Vehicles, What Customers Need To Know

Subaru has a settlement in place now for its cracked windshield lawsuit. See what Forester, Outback, Ascent, and Legacy owners will receive under the proposed settlement.

Subaru of America has settled its cracked windshield lawsuit for the owners of 1.4 million vehicles. According to Top Class Actions, Subaru of America agreed to settle the lawsuit with the owners of the 2019-2022 Forester, 2019-2022 Ascent vehicles, 2020-2022 Outback, and 2020-2022 Legacy vehicles.

Before I give you the proposed settlement details, here is information on the history of the Subaru cracked windshield lawsuit. I started covering the lawsuit more than four years ago. Several lawsuits were consolidated into one class action lawsuit. 

According to the lawsuit, "defects cause minor chips in the glass to spread across the windshield." Subaru argued that the windshields met all federal safety regulations. While the plaintiffs complained that dealerships wouldn't cover the cost of windshield repairs under warranty, Subaru argued that the warranty didn't cover such damage.

The class action lawsuit also alleged Subaru knew about the windshield problems because dealers were issued technical service bulletin (TSB) 12-192-15R.

According to the plaintiffs, replacing the windshield is useless because Subaru uses the same defective windshields as replacements. In addition, the class action lawsuit alleged that repairing or replacing the windshield affects Subaru's EyeSight driver asset safety technology. Recalibrating the safety system is an additional cost.

Drivers whose vehicles are included in the windshield defect class action chose their vehicle because it offered the EyeSight safety feature. "So having the technology rendered useless by the windshield defect poses financial injury to drivers."

Four Years Of Litigation

After four years of litigation, 13 depositions, tens of thousands of pages of discovery documents, subpoenas, and more involving a projected class of owners, former owners, and lessees are getting windshield replacements and refunds under the proposed settlement.

There were originally 16 named plaintiffs in the Subaru lawsuit, but only four were involved by settlement time. Subaru of America denies all wrongdoing and denies the windshields are defective. A report from CarComplaints says, "The automaker says it decided to settle the lawsuit to end the expensive and time-consuming litigation."

Here is What Subaru Of America Agreed To:

1. Subaru agreed to an extended warranty of eight years or 100,000 miles and a one-time windshield replacement as part of a class action settlement submitted for preliminary approval in the U.S. District Court for the District of New Jersey.

2. The agreement says, "The Subaru cracked windshield extended warranty is limited to a one-time replacement of the windshield. Once replacement occurs, this will end the extended warranty as it expires once the windshield has been replaced."

3. The settlement also calls for reimbursement of documented prior windshield replacements with proof of a qualifying windshield crack. Subaru customers will only be reimbursed if damage was caused by residual windshield stress, not any other cause.

4. The cracked windshield settlement says there is a process Forester, Outback, Ascent, and Legacy owners must go through to "prove that their loss was caused by the alleged defect as opposed to impact damage that would have caused a cracked windshield regardless of any alleged defect."

Subaru Has A New Process For Manufacturing The Defective Windshields

5. The settlement agreement says, "The new windshield will be manufactured with a revised process that substantially reduces the likelihood of a crack/damage occurring to a windshield from a minor impact and residual stress."

What Should Customers Do?

Subaru Forester, Outback, Ascent, or Legacy must know that though the parties have agreed to settle the cracked windshield class action lawsuit, a federal judge must still grant preliminary and final approval to the terms before anything is official. My 2021 subaru forester has been owned for 6 months, has had one chips and two separate cracks leading to a recent replacement. The second crack was originally a chip which cracked about 20 minutes after the original al impact. The second impact showered the inside of the car with glass. Very scary.

I have a 2020 Subaru Forrester that has a cracked windshield. It happened late last year. I was sitting in my car and had turned on the heater/defrost because it was cold outside and suddenly a crack started growing across my windshield. I haven’t had it repaired yet as I was saving the money to pay my insurance. Should I take it to my dealership instead?? I am furious about this as I also had a 2018 Subaru Outback with the parasitic battery drain that they couldn’t “fix” so we traded it in and got the Forrester. No I’ll have a new battle with Subaru to get this windshield replaced??!!

I own a 2019 Subaru Forester touring . The front windshield cracked at the bottom right corner and was over 18 inches long. This happened in January 2024.

Bought my 2019 Subaru in February 2019. Just put my FOURTH new windshield on it. I was averaging a new windshield every 8 to 10 months.

My 2018 Forester has had no cracks (yet).
So, I wonder why 2018s were excluded? I'm writing this mostly to say our other Subaru, a 2008 (yes, 2008) Impreza developed a single crack that ran from the far right passenger side all the way across to almost block the driver's view. No known cause. No Eyesight on that old car. Because of bad quality overall these days, and a lousy new owner of our local dealership, we have bought our last Subaru, and will likely go Mazda or Toyota.

I own a 2017 Subaru outback with the eyesight technology that was cracked and replaced two-three years ago by safe-lite. About maybe two months later another crack appeared, haven't fixed it yet. Please advise on next step

I've had to replace 2 windshields in two different Legacy vehicles. A 2020 Legacy and just recently, a 2022 Legacy. Neither appeared to be from road debris hitting them.

I bought a 2020 outback in July 2020, windshield Cracked 12 hours after purchase. It was a tiny pebbles that it the windshield. Fixed it now last summer same thing tiny pebble from the road flew up, hit in same spot as before and the Crack has gone from passager side all the way up and across to driver side. It is so expensive to fix at least 900 when I last checked. Really makes me want to trade it in.

After purchase of a vehicle, I was sold an insurance for my windshield which only covers 2 years. I believe for around fourteen hundred dollars.... They are more than making their money back on this ridiculous insurance. Extended insurance if you will....

My 2019 outback got a chip that spread into a huge crack a year or so ago. 3? Or was it 4 windshields later, an inability to calibrate the eyesight, a broken camera, a replaced camera AND finally it was fixed. Like, what the what?
I see 2019s are not on the action law suit. It was so frustrating. Luckily our car insurance covered the whole thing or we'd have been out a huge chunk of change.

I purchased my 2021 outback and within 72 hours my windshield was cracked. I was encouraged by the person processing our purchase that I should take the windshield extra coverage as it is expensive to replace. Took 3 months to replace it. Got a third cracked windshield and my car is barely 2 years old. We have a 2000 Subaru that still runs with over 200,000 mi and we've had one chip in the windshield but never had to replace it .

My 2019 Forester has two cracks that started on the top passenger side of the windshield and are now approaching the line of sight on the driver's side. I have no idea what caused either of them.

I heard that distinctive rock hitting the windshield. No big deal then I heard and watched the glass split 12” in one spurt. Did you know glass plotting is a weird sound. And a mile down the road it surge again to 24” or so. I got home and booked the repair. From the rock hitting to splitting it was less than 30minutes.

We got our 2024 Ascent limited November 9, 2023. November 26, 2023 crack appeared below the wiper and extended upwards in the middle of windshield. I paid for the replacement plus the cost of the installation and calibration at the delearship where we got our ascent limited for $1500.00. April 26, 2024 another crack appeared from right middle side of the windshield slowly growing and extending closer to the middle. We are hesitant to get it replace since we know that it will cost us another $1500.00. We had plenty of experience driving different cars but never we experienced this crack windshield showing up so frequently.

On 30 April 2024, I bought a CERTIFIED 2022 Subaru Outback XT Touring with 27396 miles “AS IS” from a Subaru dealership. I added the Gold Plus upgrade to Certified Pre-Owned coverage. I drove the car home, parked in my driveway. The next day, mid-morning, I went out to the car and the windshield had a “T” shaped crack with bottom of the crack extending to the bottom edge of the glass. No signs of impact. Subaru dealer said only recourse was through my insurance company. $500 deductible. Safelite will do the work. Makes loving my Subaru just a little tougher.

We own a 2019 Forester and a 2020 Outback, and although we haven’t experienced any cracked windshields yet, we were aware of the possibility and we’re just waiting until we had one. Nice to know they will be under warranty now.

I own two 2023 Subaru Ascent Tourings, and both had windshields replaced within first six months of ownership. I carry full coverage insurance with a zero comprehensive deductible, so my cost was zero, but hassle and waiting for service was a pain in the hind end.

I drive a 2020 Subaru Ascent and recently noticed a that there was a crack running down my windshield. Still there screams to change due to eyesight sensors.

We had to replace the windshield on our 2019 Subaru Outback (not covered by the proposed settlement) 5 times in 3 years. One was within 24 hrs after replacement! We are fortunate that our insurance covered it each time, but it still cost us each time for the deductible. I don't know why the proposed settlement doesn't cover the 2019 Outback, but it should.

2021 Forester, bought Dec 2023. Tiny chip turned into a crack across the windshield right about eye level. Will it be covered under the settlement, or will they say the chip excludes it from being covered? Hope so, Safelite and Glass America quote approx 1200.00, 2-3 hours to do the job, and 40 miles from home. PITA.

Safelite and Glass America quote approx 1200.00. Takes 2-3 hours, at a shop 40 miles from home, will have to kill time somehow. Curious about the process they will use to determine if it qualifies under the settlement, and how to follow the progress of the settlement.

How do I join this lawsuit? I was driving my Outback when my windshield was hit by a small rock. It started out as a tiny little chip. It ended up cracking all the way across my windshield.
