New Subaru Cracked Windshield Lawsuit Settlement Involves 1.4M Vehicles, What Customers Need To Know

Subaru has a settlement in place now for its cracked windshield lawsuit. See what Forester, Outback, Ascent, and Legacy owners will receive under the proposed settlement.

Subaru of America has settled its cracked windshield lawsuit for the owners of 1.4 million vehicles. According to Top Class Actions, Subaru of America agreed to settle the lawsuit with the owners of the 2019-2022 Forester, 2019-2022 Ascent vehicles, 2020-2022 Outback, and 2020-2022 Legacy vehicles.

Before I give you the proposed settlement details, here is information on the history of the Subaru cracked windshield lawsuit. I started covering the lawsuit more than four years ago. Several lawsuits were consolidated into one class action lawsuit. 

According to the lawsuit, "defects cause minor chips in the glass to spread across the windshield." Subaru argued that the windshields met all federal safety regulations. While the plaintiffs complained that dealerships wouldn't cover the cost of windshield repairs under warranty, Subaru argued that the warranty didn't cover such damage.

The class action lawsuit also alleged Subaru knew about the windshield problems because dealers were issued technical service bulletin (TSB) 12-192-15R.

According to the plaintiffs, replacing the windshield is useless because Subaru uses the same defective windshields as replacements. In addition, the class action lawsuit alleged that repairing or replacing the windshield affects Subaru's EyeSight driver asset safety technology. Recalibrating the safety system is an additional cost.

Drivers whose vehicles are included in the windshield defect class action chose their vehicle because it offered the EyeSight safety feature. "So having the technology rendered useless by the windshield defect poses financial injury to drivers."

Four Years Of Litigation

After four years of litigation, 13 depositions, tens of thousands of pages of discovery documents, subpoenas, and more involving a projected class of owners, former owners, and lessees are getting windshield replacements and refunds under the proposed settlement.

There were originally 16 named plaintiffs in the Subaru lawsuit, but only four were involved by settlement time. Subaru of America denies all wrongdoing and denies the windshields are defective. A report from CarComplaints says, "The automaker says it decided to settle the lawsuit to end the expensive and time-consuming litigation."

Here is What Subaru Of America Agreed To:

1. Subaru agreed to an extended warranty of eight years or 100,000 miles and a one-time windshield replacement as part of a class action settlement submitted for preliminary approval in the U.S. District Court for the District of New Jersey.

2. The agreement says, "The Subaru cracked windshield extended warranty is limited to a one-time replacement of the windshield. Once replacement occurs, this will end the extended warranty as it expires once the windshield has been replaced."

3. The settlement also calls for reimbursement of documented prior windshield replacements with proof of a qualifying windshield crack. Subaru customers will only be reimbursed if damage was caused by residual windshield stress, not any other cause.

4. The cracked windshield settlement says there is a process Forester, Outback, Ascent, and Legacy owners must go through to "prove that their loss was caused by the alleged defect as opposed to impact damage that would have caused a cracked windshield regardless of any alleged defect."

Subaru Has A New Process For Manufacturing The Defective Windshields

5. The settlement agreement says, "The new windshield will be manufactured with a revised process that substantially reduces the likelihood of a crack/damage occurring to a windshield from a minor impact and residual stress."

What Should Customers Do?

Subaru Forester, Outback, Ascent, or Legacy must know that though the parties have agreed to settle the cracked windshield class action lawsuit, a federal judge must still grant preliminary and final approval to the terms before anything is official. We have a 2022 Legacy with 20,700 miles. One day after its 2 year anniversary, we had our third windshield replaced.
We reached out to Subaru expressing our concern that with the frequent windshield replacements, our insurance would go up or they would refuse to cover future windshields. My husband and I are reluctant to drive the car for fear of getting another crack. The windshield does not chip… it cracks. Subaru’s response was you have glass coverage under your insurance policy.

I have a 2017 Subaru Forester and took a road trip last week. I felt a pop against the windshield as I was driving but didn’t notice any kind of damage. The next afternoon I got into the car after leaving it parked for a couple of hours in the hot sun and noticed a crack extending from the top of the driver’s side for about 12 inches. Not sure what my options are now. Go to a Subaru dealer? Get it replaced by SafeLight? If it costs around $650 and my deductible is $500, I might be better off not making a claim on my auto insurance to prevent my rate from going up. Thoughts?

I own a 2019 Subaru Outback that the original windshield did fine for 4 years until a rock chip caused a crack. We replaced the windshield in August of 2023, then a crack appeared in December, but nothing had hit the windshield. We had that one replaced in January 2024. Then there were additional unexplained cracks in February, April, and now 2 more cracks in May 2024, the latter happening within 2 hours of picking it up from the dealer. We LOVE our Outback, but these repairs -even though they’re covered by a warranty- are becoming excessive. We are getting tired of replacing the windshield with another windshield that lasts half as long as the previous one.

I have a 2017 Subaru Outback. This morning I walked out to a cracked windshield.. out of the blue. I had no idea the windshields were so bad. I’m guessing my insurance will be the way to proceed.

I have a 2021 Subaru forester. I leased it brand new and the windshield cracked. I replaced it and paid in full but was unaware of this lawsuit. Once I replaced the windshield at Subaru in nh. The windshield was very blurry and now there is another small crack I hope right hand corner. I called them and got no call back.

I'm about to replace my windshield for the THIRD time in one year, 2022 Outback. In all cases, there were small dings that immediately spread and became major cracks.
I'm certainly not going to use factory Subaru glass this time.

I’ve been driving for many years. I have replaced one windshield on a Mazda. Since we bought our Outback new in 2022 we have replaced one and are having the second windshield replaced today. So expensive and so ridiculous. I thought Subaru was a good vehicle option, it isn’t.

I was driving on the interstate with a friend heading to the beach this past weekend when my windshield starting cracking from the edge of the driver's side. Initially, it cracked for about a foot and a half. Then it crept more and is now at half of the windshield. I didn't hear anything hit the windshield.

I had two Subaru windshields crack with small rock hit. Third windshield was done away from dealer with alternate glass provider and has had a couple rocks hit it without even a chip. Subaru failed me on windshield.

Today I drove out of my driveway and made a right hand turn, as I proceeded I heard crack sound and then I see about a 12 inch crack in my windshield. I drive a 2018 Subaru Outback with only 40,000 miles. When I came home I looked up if there were any recalls, and then I saw your posting. I'm not sure what to do, maybe you can advise me.

Outback 2020. Windshield cracked from one side to the other. No idea why. Replaced my windshield July 2023. One month later, small chip, cracked from center to let side within approx 10 miles. One week later I heard a pop and saw a new crack from center all the way to the right side.

We just noticed a small chip high on drivers side of windshield. Four days later it turned into a 6 in crack. We rarely use the car and once a week take it on the highway for short periods. Neither of us heard or saw and rocks, debris, etc. hit it. It just appeared. The replacement cost at Safelite is $2000. I took it to my dealer and contacted Subaru Customer Advocacy to explain my concerns about the integrity of their windshields going forward.

I own a 2020 Subaru forester that experienced a mysterious crack in the windshield. I have been following the windshield problems on the internet for several years because I as aware of problems four years ago. I asked the dealership more than once about the problems and was told they had no knowledge of the problem. When my windshield cracked I immediately contacted my dealership . I was told once again that they had no knowledge of the problem
and that I would have to have my windshield replaced by Windshield Glass in Roanoke Va.
I did this at the cost of 1,000.00 dollars out of my own pocket. When I became aware of the
lawsuit settlement I contacted Subaru Customer Service and was repeatedly told there had not b been a settlement and if there was a recall I would be notified. I felt like they were aware of the settlement but would not talk about it or refer me to their legal dept. I am very frustrated about this situation and would very much appreciate it if you could give me some clarity.

My windsheild cracked at the top/seam passenger side came then continued across my windsheild to obscure my driver side. You can actually see that the glass separated at the seam. Nothing hit the window.

2022 Subaru ascent. 1st windshield had 4 rock chips (1/2”) and a separate unrelated crack that started from side top that within 2 weeks spread completely across windshield. Got windshield replaced. Now have another crack that started from bottom passenger for no apparent reason and has spread in a snake pattern across windshield within a few weeks. In all my vehicles (I am in my 50’s) have never had this happen not just once but twice in under a year.

The windshield on my recently purchased 2022 Subaru Outback spontaneously cracked sometime during the night a couple of months ago. It is dealer car with 9000 mile when purchased used in late 2023. After researching the cracking, I took the car into a Subaru service center to discuss the cracked windshield. As suspected, the service writer examined the myriad cracks until he located the initial impact site. He removed a pen from his breast pocket and probed the area until the point caught on what he claimed was a hole caused by a stone impact. On closer examination I could tell the slight indentation in the glass occurred where several short parallel cracks intersected with a larger crack causing a chip of glass to slough off.

The service writer I spoke with denied any knowledge of spontaneous cracking despite the service bulletin sent out. It is my hope that Subaru dealerships will soon contact owners about bringing their vehicles in for an initial assessment. And I further hope that dealers come up with an accurate method for distinguishing between a stone impact crack and a spontaneous crack.

I’ve had this SAME issue in my 2019 Outback and it’s incredibly frustrating. The tiny chip spreads in less than a day leading to having to have the entire windshield replaced. 4 cracks in 3 years

I bought a 2016 Subaru Outback in August 2015. Since that time I have replaced the windshield twice and just had it crack from the bottom again this week. when it cracks it makes a loud sound and there does not appear to be any damage and minutes later you se a crack starting to move up from the bottom of the windshield and it just keeps on moving branching off and creating circles and going back down. This time there were no other cars within a distance of kicking up a rock. Neither of us saw a projectile of any kind and we were looking out the window when it happened. Appeared to be spontaneous. My other 2 breaks started the same way and there were no impact sign obvious when I examined it. The technician said it was caused by impact. One happened while parked in the garage. This is the 3rd windshield in less than 9 years. I am in my 70s and before I got my Subaru, I had only had 1 broken windshield since I started driving at 16, almost 50 years. I told the tech that no rock hit the windshield that I heard it crack when I got in the car while it was parked in the garage. He said it was from an earlier rock hit, that he could tell from the crack. I told him that I examined it and there was no impact. He said "Well I examined it and there was". Car was purchased at Dick Hannah Subaru in Vancouver, WA. I believe the first time it was under warranty, the second time insurance paid for it after deductible. I will be calling and taking it in againsoon.

The windshield on my 2022 Ascent cracked half way across directly in line of sight of driver after a small crack in black side edge of windshield. Subaru and the Appearance/Care Guard would not pay for the replacement. I had to pay the $500 deductible and my insurance premium was increased.

two cracks formed in my garage - overnight.

one from the driver's side
- starts in the black, goes across the field of vision
- and then turns down as two closely parallel cracks

then another crack from the passenger side
- again, goes from the black towards the center
- looks like a roller coaster

the two cracks don't meet - never seen anything like it

taking a picture of glass is tough - so I shot a video - you can use a credit card from the outside part of the glass to hear how the card encounters the crack as it travels across

the service manager verbally told me to demand that the repair shop use OEM glass so I don't run into vision system warranty issues.

i haven't replaced the windshield yet - feel like I'll lose my evidence.

this article was posted in April - it is July now. any estimate on when the next steps will be available?

I have a 2019 forester. I am on my fourth windshield. My car only has $61,000 miles on her. As of right now the fourth windshield has a crack in it.
I am so frustrated that I am waiting to replace it till I have to. The crack speed overnight that I did not even have a chance to have it fixed. What can I do? Any information would be helpful

Bonjour, Je suis propriétaire d'une Subaru 2021 outback XT, acheté neuve chez Option Subaru à Quebec et j'ai constaté que mon pare brise avait une fissure du coté gauche qui a commencé à s'étendre sans aucune raison.
Je n'ai pas reçu de pierre ou d'objet pouvant justifier cette fissure.
J'ai eu le même problème avec ma Subaru 2018.J'ai payé la réparation à deux reprises en 2018.
Maintenant, le même problème se produit. Le concessionnaire a t-il des obligations dans une telle situation ?

My 2021 Ascent is on it's 3rd windshield and my 2023 Ascent is on it's 2nd. I had the same problems on my 2020 Ascent and my 2017 outback too. This is a ridiculous problem that is pushing me towards a Volvo...
