Subaru Battery Drain Lawsuit - How The Final Settlement Affects Owners Now

Subaru of America’s battery drain lawsuit gets final approval. Here are the settlement details if you are a Subaru Forester, Outback, Ascent, Legacy, or WRX owner.

Subaru of America’s battery drain lawsuit has reached a final settlement. Subaru of America (SOA) has been battling an issue with drained batteries on the Outback midsize SUV, Forester compact SUV, Ascent SUV, Legacy sedan, and WRX sports car. The first lawsuit from 2020 and a second class action in 2021 against SOA alleged the Subaru vehicles had defective electrical systems causing premature battery failure. Now owners will be compensated.

A recent report from Bloomberg Law (by subscription) says the terms of the nationwide class settlement include payments for out-of-pocket repair costs up to 165 percent of the expenditure, warranty extensions, and a software update that improves the on-board computer’s “charging logic,” according to earlier filings in the U.S. District Court for the District of New Jersey.

The deal is fair, reasonable, and adequate, Judge Joseph H. Rodriguez said Tuesday. He also approved $4.1 million in attorneys’ fees and expenses.

Which models are affected by the Settlement?

According to the Subaru battery settlement website, the Subaru vehicles in the lawsuit settlement include the 2015-2020 Subaru Outback, 2015-2020 Subaru Forester, 2015-2020 Subaru Legacy sedan, 2015-2020 Subaru WRX, and 2019-2020 Subaru Ascent 3-Row SUVs.

What does the Settlement provide?

1. Extended warranty service for qualifying battery failures experienced on or after the Date of the Notice. The Settlement also provides, where applicable, cash reimbursement for:

2. Battery replacements and related battery testing and diagnosis performed by an Authorized Subaru Retailer, or in some situations, an independent third party, for qualifying conditions on a Settlement Class Vehicle before the Date of Notice (“Pre-Notice”);

3. Towing services in connection with a Pre-Notice Qualifying Battery Failure.

4. Reasonably Reimbursable Costs related to a Settlement Class Member being stranded due to a Pre-Notice Qualifying Battery Failure.

What should Outback, Forester, Legacy, WRX, and Ascent owners do now?

This is the only way to get a reimbursement. The deadline to submit Claim Forms and supporting documentation is 60 days after the Effective Date, which could be as early as May 5, 2023. Subaru owners do not need to do anything now to ensure coverage under an extended warranty.

I have a 2012 Outback that has to be started every day or the battery dies. I'm not happy the settlement only goes back to 2015 but that doesn't concern me as much as there seems to be no fix for this. I've taken it to the local dealership, before the settlement, and they acted like they had never heard of this. They blamed the battery as being defective and sold us a new one. That battery didn't last and we had to get another. I've been left stranded at 3 times because of dead batteries. We bought a new Outback in 2021 and the dealership offered us 5k for the old one as a trade in. I should have taken the deal. Why is there no fix for this?

After AAA changed 3 batteries, I took the car to Subaru of Morristown. They never mentioned the drainage problem, removed a good battery, and replaced it with their own. When the car would not start again I had the battery jumped and took it back.They removed a fuse which would allow the battery to function without draining. Now I have no Bluetooth and I'm out the money for two batteries. Despicable!

My battery on my 2020 Forester has now left me stranded 2 times. I fully charge it but next day car won't turn over. There is a huge problems with with dead batteries on these Subarus, I was never informed by Subaru that there was a Class A Action Law suit settlement, but not clear whether I can still submit a claim for a Battery replacement> I don't want to bother going back to the dealer as they will do nothing for me except charge me for a new crappy Battery.

This “settlement” with Subaru is total nonsense! There is something in the vehicular that is draining the battery when vehicular is off. My wife’s 2019 Legacy has had the battery replaced twice … by me. The “computer fix” has been applied by Subaru AND it still kills the battery. The only folks that came out of that lawsuit on the plus side were the lawyers and Subaru who can now brush off hundreds of thousands of owners that are stuck with this problem. The Subaru dealer told us that this is a “normal thing that we will need to live with because all these new cars have so much electronic stuff in them!” What BS! This is my wife’s second and last Subaru. I’ve added a plug in trickle charger to the cars battery circuit that she plugs in whenever the car sits fore more than a few hours. Share the love!

I was lied to by Exeter Subaru in Stratham NH over and over and they never even told me about the law suit going on. I found out about it on my own after being stranded 4 times with 4 battery replacements. Now that I have shown them that I filed in settlement and have reference code number to show they are acknowledging the problem but they told me nothing was wrong with my car over and over. 2 weeks ago my car battery died again. That is the first time they acknowledged knowing about the law suit when I brought it up with my settlement information. Subaru is a company that is dishonest and does not stand by their product- cars- when you have issues they tell you nothing is wrong, they have caused thousands of customers undue stress and we are stuck with lemons they are not willing to fix. Our batteries will continue to drain and die as long as we own the cars so the only persons who made out are the large subaru corporation rich folks and the lawyers who settled for another temporary fix not a solution. I paid 35,000 in cash for my car taking money from my retirement account- big mistake, now I am stuck with a lemon and will never be able to afford to pay in full again and I am struggling!!! Subaru does not care about its customers, don't believe their false advertisements, I will never buy another subaru again, They know exactly what part is wrong and would not fix because it would cause too much money to fix the electronic issue they sold to us, It is sickening and I don't know how the subaru and lawyers live with themselves.....We will all have judgement day.....Wronged Customer

I purchased a 2019 Subaru Outback on 2/11/2023 at Capitaland located at 37 Saratoga Road in New York. Ever since end of February, I have been having issues with the battery in the car. When I stopped flashing people down for jump start, a friend lends me a portable battery charger. Counting, this is the 7th time. I paid $22,471.00 in cash for a car to come down only to aggravations. Today, I finally took the car to the dealer which all along, they knew there was a problem going on with the car. I feel disgusted and disappointed. They don’t have the parts to fix it correctly. So they unplug the fuse that causing the draining of the battery over night. Because of that, the speakers in the front of the car must be disabled. Can you imagine? I deserve to be compensated for going through all of these. Won’t you agree?

My 2019, Subaru Outback's battery died on me. I bought it with 10k miles and bought the Gold package. I was planning a trip and the month before my battery died. That same week I had called Subaru since I received the notice about the battery lawsuit and was told I was shit out of luck with getting a new battery. I purchased a new one myself and installed it. It ran fine. We went on our trip to WA and on our way out my new battery died. I called my Gold service and our tow guy jumped the battery and we took it to Auburn Subaru. It was on Friday that we were leaving and they wouldn't get to my car until that following Monday. We were stranded and had to get a rental car for the weekend and book a hotel for 3 days. Tow guy advised with all the battery issues he sees with Subarus to get the car checked. Told him I had a new battery a d he said it isn't a battery as much as the electronics and cells issues connected to the battery. He advised to not drive back to Boise until my car gets looked at. Subaru denied my stranding expenses claim of over $2500 for being stranded in Washington. Now I have to appeal it again. I swear if they don't fix this I will start my own class action lawsuit. I am also having severe electrical issues which is getting looked at this week. I love my Subaru but after this experience I don't think I will buy, or recommend anyone getting a Subaru. My back trunk doesn't work, the safety features haven't been working, camera issues constantly, maps and online software seems to not work most of the time. Honestly if they don't appeal I will consider sterling a clas action suit. All that money and the proof that I was stranded and they refused to pay me my expenses back. $2500 is a lot of money to me. It sucks that we were stranded but we made the best of it. I had hoped that Subaru would.mske this right for those who have been stranded and they have not. I am so pissed off over this. They wouldn't willingly replace my battery knowing there was an issue and I had to buy one myself.

I was just denied to day ,6-12-2023, my reimbursement for my battery and the computer update. I bet most people were denied so we have to jump through more hoops to get a fraction of our money. I have changed my mind on Subaru, this is my first and last. I will be buying a Toyota.

Same here Michael, I was denied 6/12/23 as well. I was stranded the day after having the car serviced at Subaru! Since it was a Saturday and 150 miles from a dealer, I fixed it myself. At one point the car went in to Lock Down mode, but without the help of the Service rep at Subaru, I got recovered and on the road. My service appointment didn't anything about a re-flash? Not looking good for Subaru for my repeat business.

Except now the lawyer are trying to rip us off. We have replaced the battery 2x, paid suburu diagnosis fees, got the software update and ended up buying a portable jump starter just to be able to use the car. We provided all receipts including dealer service receipts and they are trying to only give us $138 for $500 of submitted expenses. First Suburu screws everyone and these crap scum lawyer. We're not going to play this game anymore.

My claim was denied too! My battery died on a Sunday during a holiday weekend and I had to be at work the next day. Being that Subaru dealers aren't open on Sundays, I drove directly to Advanced Auto and had a new battery installed. So, no reimbursement for the new battery since it wasn't replaced by Subaru. Thanks for nothing!

My Claim was Denied because I replaced the battery.
I am a mechanic and when the battery on my 2019 Outback failed twice at my home I replaced the battery with a slightly larger one to handle the overnight draining. The replacement batteries that Subaru installs will fail as well.
I was denied because I did not have a Subaru dealer replace it.
But the lawyers still got paid.

I own a 2016 Outback. I had my battery replaced on an emergency basis when it failed in a parking lot on my way to an airport and it would not jump. I did not know of the issues with the Subaru battery at the time. When I was at the dealer a few days later they did not tell me of the problem and they did no testing after I told them of the emergency battery replacement 3 days earlier. I filed a claim and they denied it. I appealed the denial because I had no notice from Subaru and it was an emergency. They have summarily denied the appealed claim saying "The claimed repair was not completed by an authorized Subaru retailer and you did not contact Subaru within 10 days preceding the repair." Between the battery and 2x repairing "Subaru glass" broken windshields I don't have confidence in their product. Only the attorneys have benefitted from this settlement.

First of all i never received any notice in the mail regarding my battery issue. I have a 2019 outback touring 3.6, I spent good money on what i thought was a good car. I have been stranded numerous times because of battery failure, the dealer has replaced the battery two times and tried other things at my cost and never mentioned anything about this known issue. I just found out about the lawsuit, is their any way to join it now or am i to late and if to late what can I do, my car was towed again to the dealership with a drained battery, my insurance company will not cover it because i have had it towed to many times this year! Why has no recall been issued to fix this problem. If this was GM,FORD or CHRYSLER (Stallantis) they probably would have sent out numerous recalls. They know about the issue but refuse to fix it. I hope everyone reads all of these posts and thinks twice before buying a subaru!

Our dealer lied to us saying remote starter is the problem .four batteries later I found out myself that the dcm is the problem. Removing star link fuse fixed it so far.2017 forrester not happy.

Battery failure. The battery failed in December 2022 and they replaced it. I had to share in the expense which I did not appreciate and out the battery has failed again and they’re telling me I need a new one at 360 some dollars I am frustrated by this I don’t understand why they can’t replace the battery when there seems to be a problem they tell me that the second battery I got had no warranty that seems absurd. I don’t know what to do. I’m totally frustrated with this

I still have the 2016 Outback that used to have the junk battery (I called it a riding mower battery !), and that had the Delay-Recharging-Battery-for-30Miles-Or-30Minutes-WhichEver-Came-Last-Computer-Controling-Software. I am a retired Electrical Engineer and I FIXED the Subaru Design with my own Design Changes, and I made the “Mistake” of telling Subaru Outback Forum Administrators exactly what I did !
RESULT: They had me BANNED FOR LIFE from not only accessing any Outback Forums, BUT their criminal behavior went so far as to BAN MY IP-ADDRESS from having Internet Access to ANY SUBARU OUTBACK FORUM, including access to the Subaru results of the Lawsuit: I can not read it !
In addition, I also can NOT access any Subaru Outback Forum internet info for on-going Maintenance Problems or Solutions to Drivability issues for the Outback that I still own and drive !
This is Criminal behavior, and it is a level of Cowardice that I have NEVER EVER SEEN BEFORE BY AN AMERICAN COMPANY ! Upon checking the fine print, I discovered it is actually a cowardly CANADIAN corporation that has control of these Subaru Forums ....... !!!!

STARLINK draining the battery!!!! Replace/bypass the DCM!!
Subaru has extended the warranty and
Gerald Subaru claims my Starlink is draining the battery.

Hi, I bought my 2019 Legacy new from Gerald Subaru of North Aurora, Illinois. About 3 years into owning, my battery started dying occasionally including twice at the airport. I had the battery replaced at Walmart out of convenience and cost efficiency. (I had already spent $$ on a portable charger and used it several times.)
Less than 6 months later (Jan 2024), the new battery was dying on me. That’s when I found the settlement information online. I took the car back to the dealership. They told me that they could not help me because it was no longer a Subaru battery. They said battery couldn’t be charged to prove what was draining it. They told me I needed to buy a larger capacity battery $450 so they could test it. I told them to forget it and used the 1 year Walmart warranty to have the battery replaced.
Now it’s April 2024, just 3 months later, and my battery dies. I take it to Gerald Subaru dealership. They are “so happy for me that Subaru has extended the warranty.”
They are replacing the DCM module with one with a bypass that stops the Starlink from using the battery. (Good thing I don’t use Starlink.)
Are they also replacing my battery with that $450 one I supposedly needed? Nope!
The service manager said they can only do what Subaru will reimburse them for. “We’re talking thousands of repairs,” he said.
This should be a recall!
